New bipartisan bill could end ban on cannabis consumers getting security-sensitive jobs

The short version: 

A bipartisan bill was recently introduced to the House to end the consideration of prior or current cannabis use when assigning security clearance for federal employment. 

The passing of this bill would help pave the path to the end of federal prohibition and gives more hope to the cannabis market moving forward. It also makes NOW a great time to invest in well-vetted cannabis businesses.

What is this bill? 

The Cannabis Users Restoration of Eligibility (CURE) Act would:

  • Prevent prior or current cannabis use from becoming grounds for failing to receive security clearance

  • Prevent previous or current cannabis use from becoming grounds for being unsuitable for federal employment

  • Allow someone previously denied a security clearance or a federal job opportunity based on cannabis use a chance to have that denial reviewed.

Who is supporting this bill?

The CURE Act has bipartisan sponsorship by Representatives Nancy Mace (R-SC) and Jamie Raskin (D-MD). It’s been endorsed by the Drug Policy Alliance, the Due Process Institute, the Law Enforcement Action Partnership (LEAP), the National Organization for the Reform of Marijuana Laws (NORML), and the U.S. Cannabis Council. 

What impact does this bill have on the cannabis industry?

Federal law moves slowly – much slower than US culture. The passing of this bill would indicate a large enough culture shift around cannabis that the federal government is now willing to accommodate cannabis use among its employees. This bodes very well for additional significant changes around federal cannabis law, including the end of prohibition. 

Is now the right time to invest in cannabis?

Short answer: Yes. 

Longer answer: Cannabis companies still have limited access to capital. So businesses with access to noninstitutional money stand the best opportunity to succeed until the SAFE Banking Act passes and institutional money takes over.
